In the ongoing appeal of the judgment from the presidential election petition tribunal, the Supreme Court has determined that it lacks jurisdiction to admit new evidence.

The case, identified as SC/2023 CA/PEPC/05/2023, involves Atiku and the Peoples Democratic Party (PDP) as the Appellants, while the Independent National Electoral Commission (INEC), Bola Ahmed Tinubu, and the All Progressives Congress (APC) are the Respondents.

The Appellants, in their Notice of Appeal, expressed dissatisfaction with the decision outlined in paragraph 2 of the consolidated judgment of the Court of Appeal (sitting as the Presidential Election Petition Court). They appealed to the Supreme Court, citing grounds set out in paragraph 3 and seeking the reliefs specified in paragraph 4. The relevant sections of the consolidated judgment are from pages 487 to 752, along with the concurring contributions and rulings.

Previously, the Presidential Election Petition Court dismissed the petition filed by the PDP and Atiku challenging President Bola Tinubu’s election. The tribunal also deemed the petition filed by Peter Obi of the Labour Party against Tinubu’s election as “unmeritorious.”
