The Ogun State High Court in Ijebu Ode has rendered a verdict on an ex-parte application brought forward by Wale Adedayo, the suspended Chairman of Ijebu East Local Government.
Adedayo sought to halt further investigations conducted by councilors from Ijebu East LG, who were probing allegations of financial mismanagement against him.
Previously, councillors from the Ijebu East Legislative Council had suspended Wale Adedayo as part of their ongoing investigations into the alleged financial mismanagement. They instructed his vice to take charge until the investigation concluded.
In a ruling on Tuesday regarding the ex-parte motion, which was presented by the plaintiff’s counsel, Barrister O.T. Are (representing Adeyinka Kotoye SAN on behalf of Adedayo), the presiding judge, Justice Ayodele Omoniyi, dismissed the application entirely.
During the proceedings, as informed the court about the ex-parte motion dated September 6, which sought an interim order to restrain the defendants, their agents, and associates from proceeding with an invitation letter sent to the claimant. The letter had asked Adedayo to appear before the Council on September 14, or alternatively, ordered the parties to maintain the status quo.
In its judgment, the court observed that the application was not timely, as Adedayo had received notice of the resolution on August 31 but waited until September 11 to file his application.
The judge said, “delay defeats equity.”
